Copyright infringement due to own design

Hello,

i wanted to put up my best-selling designs on Sweatshirts / Long Sleeve. But, they got rejected due to "copyright" issues. Since they are of course my own designs, which I uploaded on T-Shirt previously, this doesn't make any sense. So the only reason I see, is that the amazon software doesn't recognize that the designs have been uploaded from my account. What can I do to upload my designs on sweatshirts now?

Hello - I suggest that you contact Merch via email and find out exactly what the challenge is - including links/screenshot of your original design.

Most likely the Brand, Title, Bullets or Description

I used the same Brand, Title, Bullets, Description as in my T-Shirts' of the same design. Also, Title and Bullet issues are rather Trademark problems than copyright cases.

Give them your copyright registration VA numbers from the library of congress and all will be good.

I did not apply for any copyright on my merch designs. Do you do that?

double check your title and bullet points for ANY possible trademark infringements ... especially ones that are live

As I said, same description as in my according shirts, which are already live

Yes. You can copyright a single design or compile a group (many people do this) and copyright. The copyright office these days will grant copyrights quicker if you submit originality v. Just using someone-else's fonts. So if you used a font and your not particularly copyrighting your font per say, then they have the right to not grant you registration. If you are unique enough like having an illustrated element you drew your application goes quicker and maybe distress led your fonts and manipulated sonits yours ... okay maybe. The older days where easier but these days you really need to have that originality. That's why when I see someone say their copyright was taken (what really was?) If you can use someone else's fonts then so can they unless you are licensing it exclusively and they aren't. Same goes with stock art or clipart. They can use it too. The layout is tricky because if you can both use the same fonts and elements (clipart or stock art) you both have the right to create. You can always be the first to publish the way you composed your style and make sure you have that proof of date if you don't have a copyright registration and sometimes Amazon will know that by seeing your upload date. I have copyrighted over 100,000 designs for the last 25 years. It's a pain but i did and still do. So I use those elements to derive new content/styles. Just food for thought to help. Hope it did. I know the saying if you design it ... then it's automatically copyrighted. That's a sticky old school way of saying you own the copyrights. And sometimes that date of publication can also help using that way of thinking. Sometimes it's true but the legal aspect is much more strengthened with actual registration. It also gives you a monetary fight against the infringer.

Thanks for the info. But that is not really my issue. I haven't copyrighted, but I want to use my own design again on Sweatshirts. Amazon should see that this particular design is already uploaded from my account and not make me block myself from uploading my own designs.

The most likely answer is you have a problem in your brand/title/bulletpoints and it was missed when you submitted your shirt design. Double check it or get another set of eyes on it. If Amazon catches it and takes it down or worse gets a complaint about it that is worse for your account than if they had rejected it in the first place. If you value your account figure out what the problem is.

I assume it's not a trademark issue if they write copyright. Trademark is in our bulletpoints, but copyright is a graphic. Please correct me if I am wrong.

The problem with many friends is the compilation of keywords And many of them lose their account in Amazon because of keywords Is there an alternative to facilitate the search for designs. I hope you are lenient because many ignorant of property rights and I am one of them
