Unoriginal Code

Although i do intend to submit apps I create. I happened to come across the apk for Flappy Bird, an app that was removed from the google play store and ios app store. I was wondering if I could submit this for free and take no credit for the app. Would it be illegal/Against Amazon Guidelines or possible to be sued over.
